 Drafting wills

Your Will ensures your family is adequately provided for when you are no longer there to provide for them. Any person 16 years of age and of sound mind may draw up a Will. To ensure your final wishes are carried out correctly, your last Will and testament must be clear and unambiguous. Without a Will, efforts will be made by the State to divide your estate fairly, but this will prove to be a time-consuming and expensive task. The execution of a Will requires certain formalities as prescribed by the Wills Act 7 of 1953, therefore consult your draftsman to make sure your Will is drawn up in accordance with the law.

Your Will can have a variety of additional clauses customised to your specific circumstances and needs such as:

- Your burial or cremation wishes

- Nominating a substitute guardian for your minor children

- A trust creation clause and a clause arranging the powers of your trustees if a trust is required (usually used to protect minor beneficiaries)

- A clause authorising disposal of assets not suitable for retention in trust to the guardians of minor beneficiaries.
